Terms & Policies

Version 2.0 — effective 16 July 2026. Approving a quotation through the client portal constitutes acceptance of these Terms.

1. Who we are & definitions

These Terms & Policies ("Terms") govern every wedding RSVP website project ("Project") ordered through this portal. The service provider is ELBACH Digital FZ-LLC, a Free Zone Limited Liability Company licensed by the Ras Al Khaimah Economic Zone (RAKEZ), Licence No. 47027285, TRN 105264259000001, Compass Building FDBC4150, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates ("ElBach Digital", "we", "us"), acting in commercial partnership with the introducing partner named on your quotation — a wedding planner, marriage service, court, venue, or consultant, in any country ("Partner"). The person or couple submitting a request is the "Client" ("you"). ElBach Digital serves Clients worldwide; these Terms apply wherever you are located.

"Package" means the service tier selected at the time of quotation (Essential, Signature, Premium, or Bespoke). "Deliverable" means the wedding RSVP website described in the selected Package. "Approval" means any confirmation given by the Client through the client portal, by email, or by WhatsApp message from the contact details provided at intake.

2. Scope of service

Each Package includes only the features expressly listed for that Package on this portal at the time of quotation. Anything not listed is excluded — including, without limitation: photography or videography, printing, physical invitations, domain name purchase, paid advertising, third-party subscription costs, event planning, and on-site support.

Requests outside the selected Package are welcome, but they are new work: they will be quoted separately in writing and are payable in advance. Verbal or chat-based assurances do not modify scope; only a written quotation issued by ElBach Digital does.

3. Quotations & acceptance

Quotations are valid for the period shown on the quotation and lapse automatically afterwards. Prices and applicable taxes are shown in the quotation currency and confirmed on the invoice.

Approving a quotation through the client portal constitutes electronic acceptance of the quotation and these Terms. We record the accepted version, timestamp, account or link used, and technical audit evidence. This commercial acceptance record is not notarization or a qualified government trust service.

4. Payment

Work begins only after payment is confirmed. Payments are processed through an approved secure checkout provider; we never store complete card details. An official invoice and payment receipt are issued after successful payment.

Where a deposit arrangement has been agreed in writing, the remaining balance is due before the website goes live. The website (including private links and QR invitations) is not published, and final files are not released, while any balance remains unpaid.

5. Refunds & cancellation — please read carefully

Because each website is custom creative work scheduled into a production queue, all payments are final and non-refundable once your Project enters the design queue (which happens automatically upon payment), except as expressly stated below or where a refund is required by UAE consumer protection law.

No refund is available in any circumstance once you have approved the final website, once the website has gone live, or once your wedding date has passed — approval and launch are conclusive confirmation that the service was delivered to your satisfaction.

Dissatisfaction with subjective matters of taste (colours, fonts, styling choices within your selected direction) is addressed exclusively through your Package's included revision rounds — it is not grounds for a refund.

If ElBach Digital is wholly unable to deliver the Project (and this is not caused by your delay, unresponsiveness, or failure to provide content), you will receive a refund of the amount paid for the undelivered work. This is the sole refund remedy.

Cancellation by the Client after payment but before design work has started may, at ElBach Digital's discretion, be converted into a credit valid 12 months toward any ElBach Digital service, less an administration fee of 15%. Cancellation requests must be sent in writing to contact@elbachdigital.com.

6. Revisions

Your Package includes a fixed number of revision rounds (Essential: one; Signature: two; Premium: three; Bespoke: as quoted). A revision round is one consolidated list of adjustment requests within the original scope and chosen design direction.

A revision is not: a change of design direction after approval of the concept, new features, additional pages or events, a new language, or re-doing work caused by incorrect information you supplied. Those are new work and will be quoted separately.

Additional revision rounds beyond your Package are available at AED 350 per round, payable in advance.

7. Client content & accuracy

You are solely responsible for the accuracy of everything you supply: names and their spelling, dates, times, venues, map locations, guest lists, translations you provide, photographs, music, and story text. We build exactly what you give us.

You warrant that you own or have permission to use all content you supply, and that it does not infringe any third party's rights or violate applicable law or public morals. You indemnify ElBach Digital and the Partner against any claim arising from content you provide.

Corrections of errors in Client-supplied content discovered after launch are chargeable if your revision rounds are exhausted. Errors made by ElBach Digital (e.g., we mistyped a name you supplied correctly) are always fixed free of charge, at any time before the wedding date.

8. Timelines & Client responsiveness

Delivery estimates start from the later of: payment confirmation, or receipt of all required content. Delays in providing content, feedback, or approvals extend the timeline accordingly; ElBach Digital is not responsible for missed internal milestones caused by Client delay. Tell us your wedding date honestly at intake — rush work agreed in writing may carry a priority fee.

If you are unresponsive for 30 consecutive days at any stage, the Project may be paused and archived. Reactivation is subject to queue availability and a reactivation fee of AED 500. Archived projects with passed wedding dates are considered delivered to the extent of work completed, with no refund due.

9. Review & deemed acceptance

When we deliver a preview or the final website for review, you have 7 calendar days to respond with either approval or a consolidated revision list. If we receive no response within 7 days, the Deliverable is deemed accepted — this protects your wedding timeline as much as our production schedule.

Where the wedding date is fewer than 14 days away, the review window shortens to 48 hours.

10. Package changes

You may upgrade to a higher Package at any time before final approval by paying the price difference; completed work carries over where possible. Downgrades are not available once design work has started.

11. Hosting, availability & duration

Your website remains live from launch until 3 months after your wedding date, after which it may be archived. Extensions are available for a fee. We rely on reputable third-party infrastructure (hosting, payment, email); we are not liable for outages, delays, or data loss caused by third-party providers, nor for events beyond reasonable control (force majeure).

12. Intellectual property & portfolio

All underlying code, design systems, templates, and tooling remain the exclusive property of ElBach Digital. Upon full payment you receive a personal, non-transferable licence to use your wedding website for its intended purpose. You may not resell, copy, or commission derivative works of the design for third parties.

ElBach Digital and your Partner may reference and display your website (excluding private guest data) in portfolios and marketing. If you prefer full confidentiality, tell us in writing before launch and we will exclude your Project — Premium and Bespoke private-link projects are excluded by default.

13. Guest data & privacy

Guest names, contact details, and RSVP responses belong to you. We process them only to build and operate your RSVP website, in line with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and, where applicable, the data-protection laws of your place of residence (such as the GDPR). We do not sell or share guest data with anyone outside the service.

Guest data is retained for 6 months after your wedding date and then deleted, unless you request earlier deletion in writing. Complete payment card data is handled solely by the secure payment provider and does not pass through our application database.

14. Acceptable use

The service may not be used for any content that is unlawful in the UAE or in your country of residence, defamatory, or contrary to public order or morals. We may decline or remove such content without liability and without refund.

15. Chargebacks & disputes in bad faith

Initiating a card chargeback on work that has been delivered, approved, or deemed accepted is a breach of these Terms. We will contest such chargebacks with our records (quotation, acceptance timestamps, delivery logs, correspondence), and the website may be suspended while the dispute is open. Genuine billing errors are always corrected promptly — contact us first.

16. Liability

To the maximum extent permitted by UAE law, ElBach Digital's total aggregate liability for any Project is limited to the amount you actually paid for that Project. We are not liable for indirect or consequential losses, or for the conduct of guests, venues, or other vendors. Nothing in these Terms excludes liability that cannot be excluded under UAE law.

17. Governing law & disputes

Regardless of where you are located, these Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. Before any formal step, both parties agree to attempt good-faith resolution within 30 days of written notice. Failing that, disputes fall to the competent courts of Ras Al Khaimah, without prejudice to any mandatory jurisdiction of RAKEZ authorities.

These Terms are issued in English; any translation is provided for convenience only and the English text prevails.

18. Changes to these Terms

We may update these Terms from time to time. The version in force when you approve your quotation is the version that applies to your Project. Material changes never apply retroactively to projects already paid.

19. Privacy requests & individual rights

Clients and guests may request access, correction, deletion, restriction, or a portable copy of personal data where the applicable law provides that right. Requests must identify the relevant event or reference and be sent to contact@elbachdigital.com. We may ask for proportionate identity verification before disclosing or changing data.

We aim to acknowledge privacy requests within 7 calendar days and complete them within the period required by applicable law. We may retain limited records where necessary for invoices, fraud prevention, legal claims, or another lawful obligation.

20. Processors, transfers & security

We use carefully selected infrastructure, storage, email, analytics, translation, AI, and payment providers only where needed to deliver the service. Providers receive the minimum data necessary for their role and are subject to contractual or platform security obligations.

Data may be processed outside the Client's country. Where required, we use an appropriate transfer mechanism or contractual safeguard. We apply access controls, private storage, audit logs, encrypted transport, rate limits, and role-scoped administration. No online system is risk-free, and we do not promise absolute security.

If a confirmed security incident is likely to affect individuals materially, we will investigate, contain it, preserve evidence, and notify affected parties and authorities when required by applicable law.

21. Cookies, analytics & AI assistance

Essential storage is used for language, session, security, and form-progress functions. Optional analytics or marketing technologies should not run until the relevant consent is obtained where consent is required. Browser controls can be used to clear stored preferences.

AI-assisted chat, transcription, translation, or content suggestions may process the text or audio submitted to that feature. AI output is a draft: Clients remain responsible for checking names, dates, translations, cultural wording, and all final published content.

22. Electronic communications & records

By choosing electronic dealing, you consent to receiving quotations, agreements, invoices, receipts, approvals, reminders, and service notices electronically. Keep your email address and phone number current. A notice sent to the latest contact details supplied is treated as delivered subject to mandatory law.

Electronic audit records may include a reference, document version, timestamps, acceptance statements, typed name, IP address, browser information, email delivery events, and a cryptographic or database identifier. Records are retained for the contract and legal retention period.

23. Partner portals & attribution

A Partner portal, link, or client access code identifies the introducing Partner and attributes the resulting Project to that Partner. The code is not a password to Client data. Clients receive separate private access to their own submitted record.

Partners may view only Projects attributed to them and may not use Client or guest data for unrelated marketing without a separate lawful basis. ElBach Digital remains responsible for the platform service; the Partner remains responsible for promises, services, and advice it provides independently.

24. Complaints, accessibility & local mandatory law

Service, billing, privacy, and accessibility concerns may be sent to contact@elbachdigital.com with the relevant reference. We aim to acknowledge a complaint within 3 business days and provide a substantive response within 15 business days where reasonably possible.

We aim to provide keyboard-operable, readable, responsive journeys. Tell us if a disability, language, or technology barrier prevents completion and we will provide a reasonable alternative channel.

These Terms use UAE governing law, but they do not remove non-waivable consumer, privacy, electronic-transactions, or jurisdiction rights that apply in the Client's country. Country-specific legal questions should be reviewed by qualified local counsel before relying on a standard electronic workflow.
